BRIEF INTRODUCTION OF HEART CARE FOUNDATION OF INDIA (HCFI) TRUST (REGD)

Heart Care Foundation of India (herein after “HCFI”) Trust was established in the year 1986 with the objectives to establish, operate, promote, run and manage institutions engaged in the advancement of research work pertaining to cardiology / preventive cardiology and to provide research facilities for carrying out basic and applied research. Since 1986 HCFI has been engaged in providing all kinds of medical aid and facilities to the people in need but not having sufficient resources at their disposal.

The trust uses consumer-based entertainment modules to impart health education and increase awareness amongst people. A leading example of this is the Perfect Health Mela, an annual event started in 1993 and attended by over 2-3 lakhs people each year. 

The Perfect Health Mela showcases activities across categories such as health education seminars and check-ups, entertainment programs, lifestyle exhibitions, lectures, workshops and competitions. 

HCFI conduct programs and camps to train people in essential life-saving techniques like Hands-only CPR for revival after sudden cardiac arrest. 

HCFI has devised an easy to remember Hands-only CPR 10 mantra and has manikins, which are used to provide on-ground training.

HCFI currently holds three Limca Book of World Records for the maximum number of people trained in Hands only CPR 10 in one go. Keeping Article 21 of the Constitution of India in mind, which guarantees ‘Right-to-life’, to a person, 

HCFI also successfully runs a project called the “Sameer Malik Heart Care Foundation Fund” based on the fundamental principle that no one should die of a heart disease just because they cannot afford treatment. Through this initiative, HCFI provides technical and financial assistance to all those patients with heart disease belonging to economically weaker sections of the society and need of surgical intervention. In the last 2 years, the lives of over 400 heart patients have been saved through this initiative. 

HCFI also regularly conducts preventive health camps in schools on a regular basis on topics such as tackling obesity, health and sanitation. 

HCFI is the only NGO in the country on whose community-based health awareness events, the Government of India has released two commemorative National stamps (Rs. 1 in 1991 for Run For The Heart Event and Rs. 6.50 in 1993 on Heart Care Festival on the occasion of the First Perfect Health Mela). On February 2012, the Government of Rajasthan also released one Cancellation Stamp (2012) for organizing a first of its kind mega health camp at Ajmer.

NEED AND OBJECTS TO SET UP THE LEGAL CELL IN HCFI :-

HCFI through its trustees has felt and realized that in many cases, people suffering from various medical problems and ailments including acute physical and mental stress resulting from various issues and problems which require immediate legal redressal. However, in the absence of proper legal advice and support, they also suffer from various health problems especially heart problems. For the above pupose, HCFI has felt genuine need to establish and set up a legal cell for giving proper and bonafide legal advice and support to the weaker and needy people on charitable basis.  

DETAILS AND PARTICULARS OF THE HEART CARE FOUNDATION OF INDIA – LEGAL CELL (EQUALITY, JUSTICE & EQUITY)

Name : The Legal Cell to be set up shall be known as “Heart Care Foundation of India – Legal Cell (Equality, Justice & Equity)”.

Head Office Address :  Heart Care Foundation of India – Legal Cell (Equality, Justice & Equity) shall run its activities from the address    E-215, First Floor, East of Kailash, New Delhi-110065.

Objectives :  The objectives of the Heart Care Foundation of India – Legal Cell (Equality, Justice & Equity) are as under :-

  • To provide all kinds of legal advice, support and services to the people at large who are in need of such services but not having sufficient resources or they are looking for legal help in order to avail and achieve the other services offered to them by the Trust in the field of medical services.  Many a times the people come across various difficulties and problems in getting proper and adequate medical aid and services from the hospitals, nursing homes and clinics etc.  They also come across various problems caused on account of misunderstanding with the concerned public authorities including police authorities.  The setting up of legal cell shall provide adequate services to all such people.
     
  • To organize and set up workshops, seminars and conferences and also publish and release newsletter for public awareness and to make people at large aware about their fundamental rights guaranteed under Constitution of India, 1950 and other laws.  To make access to justice easy and simple for the weaker and needy people and provide all support and help in this regard.
     
  • To address the legal issues of public importance and significance and in this regard to make representation to the concerned government authorities and set up contacts with the authorities to persuade and prevail upon them to resolve the said issues.
     
  • To arrange and provide for services to the needy people regarding mediation, conciliation and arbitration as need arises in order to provide immediate and faster relief to the people and save them from unnecessary cost of litigation.

GENERAL ADMINISTRATION AND MANAGEMENT OF WORK IN HCFI – LEGAL CELL (EQUALITY, JUSTICE AND EQUITY):

  1. Firstly, there shall be the registration procedure for every person who approaches the legal cell for its advice and services which shall also be based upon the eligibility criteria fixed in this regard.
  2. Secondly, the legal services required by any person shall be allocated to one of the lawyers on panel of the legal cell and it shall be supervised on regular and continuous basis.  The legal services will include:
    1. Legal advice/consultation
    2. Drafting of representation, complaint, legal notice, reply to any legal notice, rejoinder notice, petition/plaint/written statement/ reply/affidavit/appeal to be filed before court of law/ commission/forum/tribunal etc. and to prosecute or defend the legal proceedings.
    3. Appearance before court of law/commission/forum/tribunal etc. to attend the hearing and represent the concerned person in his best interest possible.
    4. Any other services including mediation, conciliation, arbitration etc. to help the person and save him from unnecessary harassment of litigation/legal proceedings.
  3. Thirdly, records of all such services being rendered and given to the persons by the legal cell shall be regularly maintained and kept.
  4. Fourthly, all the expenditure incurred in the legal cell towards the general secretarial, administration and legal expenses including salaries shall be borne by the funds/grants provided by HCFI trust and all accounts to be maintained and kept in regular course.  
  5. Fifthly, the working of the legal cell shall be on Monday, Wednesday and Friday from 5:00 PM to 7:00 PM.  This shall be subject to any urgency, emergency and extraordinary circumstances.
